In the Domestic Relations division, case types include divorces, dissolutions, legal separations, annulments, parentage, objections to CSEA orders, and domestic violence actions (civil protection orders).  Please see the Domestic Relations Court website for additional information.

General Filing Requirements

Divorces, Annulments, Legal Separations, Full Faith & Credit

The costs to file one of the above titled actions is $420.00 with children and without children $370.00. It is required that the original Complaint and 3 copies be filed. Date of marriage and place of marriage must be stated in your Complaint. Case Captions must provide full names and addresses. A New Case Designation Form, an Affidavit of Income, Expenses, and an Affidavit of Property must be filed with the Complaint. If children are involved, you must also file a Parenting Affidavit, Health Insurance Affidavit, and an Application for Child Support Services. Instructions for Service is also required at the time of filing.

Dissolutions

The cost to file for Dissolution is $400.00 with children and without children $370.00. It is required that the original Petition and 2 copies be filed. Date of marriage and place of marriage must be stated within the Petition. Case captions must provide full names and addresses. Original notarized Separation Agreement and/or notarized Shared Parenting Plan is also required at the time of filing with 3 copies. A New Case Designation Form, a Dissolution Affidavit of Property and Income (signed by both parties) must be filed with the Petition. If children are involved, a Parenting Affidavit, a Health Insurance Affidavit, and an Application for Child Support Services must be filed with the petition. Both parties must attend the "Remember the Children Program" or a hearing date will not be set.

Post Decree Motions

The cost to file is $240.00. An Affidavit of Income, Expenses, and a Health Insurance Affidavit are required with a motion if child support is modified and/or terminated. A Parenting Affidavit is also required if children are involved. Instructions for Service must also be filed with complete address. Case Captions must provide full names and address. The original Motion and 3 copies are required for filing.

Private Parenting

The cost to file is $420.00. It is required that the original Complaint and 3 copies be filed. A New Case Designation Form, a Health Insurance Affidavit, an affidavit of Income, Expenses, A Parenting Affidavit, and an Application for Child Support Services must be filed with 3 copies with the Complaint. Instructions for Services is also required at the time of filing.
